And if there are windwings on the water chances are they can not see you.
And if they are wearing those airbud headphones they cant hear you when you yell out Starboard. They also cant hear anything approaching from their blind spot including powered vessels.

The starboard rule only applies when kiters are on a collision course, so it sounds like you are using the starboard rule correctly. If kiters are not on a collision course, no-one has to yield (both can maintain their current direction). In addition to right of way, if kiters are passing closeby the other rule is that the upwind kiter raises their kite up and downwind kiter lowers kite to pass safely. This impacts both riders, so I wouldn't lump it in with right of way (which is to determine who maintains their current course and who yields)
Indeed the advantage can work, probably best amongst more experience riders and friends (or friendly folks). But on a beach break, with both "locals" and downwinders passing by, a standard rule on collision courses can be more effective (in my newbie opinion)
Rider on a wave or approaching a known freestyle area have advantage, no doubt.
Downwinders generally f@*k the whole lot up, freight trains on tracks, right of way since loading the second car at the downwind carpark

Don't forget, many newbees will have great difficulty changing course and raising or lowering their kite. We've all been there. They are easy to spot so give them plenty of room whether you have the right-of-way or not.

We share the water with yachts, windsurfers, powered craft etc.
So when approaching on opposite tacks, starboard holds his line and port yields ........ well before the point of being close.
Its really fkn simple. Its what the boats are going to do and hopefully windsurfers also so the continued attitude of kiters that they're different is bloody annoying.

Yes in the waves, rider on wave had priority or whatever local rule. Fine.
But when on a big body of water going straight at each other on opposite tacks you gotta obey the Col Regs lest you end up in court.
General riding it should never come into play. person slightly downwind just lower their kite and person upwind raise their kite.
It's just common sense and a little courtesy. Whats really to gain by beating other people to a higher wind position? (other than racing)

When kiting with boats around, Live by the basic simple rule, Might has right.
Yelling starboard at a speed boat wont see you get far, but to a hospital.
The main rule is simply that, as a vessel under way and making way, you must take all precautions to avoid a collision.
thats it. Every other rule is just a guideline. You have a collision the only thing that saves you is if you did everything you possibly could to avoid it.

Keep kites classified as surf craft.. which they are.. in QLD.
And yes of course we do everything possible to avoid collisions.. especially with other vessels not least because impacts are straight to skin and bone and we therefore have the most to lose.
As far as kiter vs kiter, they are very cautious.. more than other vessels imo because we know flying a kite we have increased risks such as tangling kites together/ getting thrown/ looped which has caused death.
Any kiter that trys to get their agenda of shouting starboard at another kiter.. good luck with that lol!

I propose a dont be a total dick rule.
so no boosting too close to others.
no showing off near newbies.
dont charge in close to the beach with a big air when someone is entering the water.
dont suddenly edge hard upwind in a head on situation.
Dont suddenly change direction and abuse others just because you are on a surfboard.
help others launch and land.
dont wear shorts over wetsuits.
Oh and you can smile, cheer others big moves, thumbs ups etc.
